Summary of Proposal:
The Ministry of Labour, Immigration, Training and Skills Development (MLITSD) is seeking feedback on a potential new regulation under the Occupational Health and Safety Act (OHSA) that would require certain workplace parties to ensure that records of cleaning of washroom facilities are posted. The proposed regulation would apply to the wide range of workplaces that fall under the OHSA, including construction projects, industrial establishments, mines, farming operations and health care facilities. Consequential amendments to existing sector regulations under the OHSA are also proposed.

Changes to the Occupational Health and Safety Act (OHSA) have been proposed in Bill 190, Working for Workers Five Act, 2024. The bill is currently before the Legislature. This proposal is contingent on proposed amendments to the OHSA, found in Schedule 4 of Bill 190, being passed by the Legislative Assembly of Ontario, receiving Royal Assent, and coming into force, as introduced.
Analysis of Regulatory Impact:
MLITSD is conducting a Regulatory Impact Analysis (RIA) of these proposed amendments. A RIA is a process of identifying and assessing the potential benefits and costs of proposed regulations. As part of this consultation, MLITSD is seeking your comments and feedback pertaining to the anticipated costs and benefits of implementing these proposed amendments.
