Consultation on the Proposed Initiatives Affecting Condominiums

Summary of Proposal:
The Ministry is exploring bringing into force some sections of the Condo Act passed by the government in 2015 but which are not yet in force (i.e., has not formally become law). These sections are aimed at strengthening protections for condo owners and purchasers by improving transparency and clarity while limiting burden.
Specifically, the ministry is exploring bringing into force certain sections of the Protecting Condominium Owners Act, 2015 (PCOA) that would amend sections in the Condo Act related to:
A.status certificates;
B.disclosure statements;
C.cancellation of purchase agreements (material changes);
D.developer turnover meetings;
E.condo performance audits; and
F.waiving remedies against developers.
The ministry is also exploring the development of regulations under the Condo Act that would support the proclamation of these PCOA provisions. In addition, the ministry is considering potential changes related to:
G.proxy forms; and
H.records access (to increase condo safety).
As part of the consultation the Ministry is interested in hearing feedback from the condo community about what could be set out in regulations to strengthen protections for condo owners and purchasers while improving transparency and clarity.
The ministry is looking for feedback on these potential changes. Members of the public can provide feedback through the survey link provided in the attachment section below. Feedback should be provided via the link by October 27, 2024.

Analysis of Regulatory Impact:
The ministry is not currently proposing any specific regulatory changes at this time. However, the ministry will undertake necessary analysis to identify associated regulatory impacts should specific regulatory changes be proposed.
